Adopt Resolution #21-173 Adopt Resolution #21-173 Authorizing an Environmental Assessment Worksheet (EAW) for the Trott Brook North Development; Case of Trott Brook North - The Excelsior Group (Project #20-103)

The purpose of this case is to authorize a Mandatory Environmental Assessment Worksheet (EAW) for a proposed 270 lot detached single-family subdivision. A project of this size requires an EAW under State Statute. 

Notification of the Public Comment Period will be made consistent with Minnesota Rules. Staff has attempted to notify all Property Owners within 700 feet of the Subject Property as part of the Sketch Plan Review with the Planning Commission on March 4, 2021. The same notification will be provided for the Preliminary Plat submittal. No notification is required to allow an EAW to take place onsite.

Please note that this does not give approval to the plat/project itself, but is a step required by Minnesota Rules prior to approval of a Preliminary Plat due to the size of the project. The Preliminary Plat (entitlement) will be in front of the City Council at a future meeting. Staff will have their consultants review the EAW, at cost to the developer/applicant, when the EAW is completed per guidance from State Statute, and will bring it back to City Council for formal approval.

Further note: this action does not give final approval of the EAW; it simply authorizes an EAW to be completed for applicable agencies and general public. 

All costs associated with the EAW and Application are the responsibility of the Developer.

Staff recommends the authorization of an EAW for the Trott Brook North development.
