Title
Adopt Resolution #21-217 Accepting Easement Related to Java Properties, O'Reilly Auto Parts
Purpose/Background:
The purpose of this case is to accept an easement for access, drainage and utilities related to the Java Properties project off Sunwood Drive NW. The Applicant has been approved for site plan and final plat approval for O'Reilly Auto Parts. The City requested an access west of the project onto Sunwood Drive, allowing for another access into the site until the site to the west is developed. The proposed easement would cross the Outlot of the plat (seen in the exhibit) allowing for a utility and roadway connection to Sunwood Drive. This easement is supported by City Staff. This easement also provides direction for future roadway connection onto Sunwood Drive, aligning said entrance with Peridot St to the north. This roadway easement will likely be removed when a future developer purchases the site from the City and builds onsite.

Funding Source:
The Applicant is responsible for all costs associated with the project.
Recommendation:
Staff recommends adoption of Resolution #21-217.
