Title

Adopt Resolution #22-046 Accepting Trail Easements Over Portions of 17353 and 17362 Iodine Street NW (Project No. 17-102); Case of Eric Thomsen

Purpose/Background:

In 2017, the City approved a plat known as Covenant Meadows, a twelve (12) lot, rural subdivision located east of St. Francis Boulevard, west of Germanium Street, and south of Trott Brook.  This plat was done as a Planned Unit Development (PUD) with the public benefit being approximately 38 acres straddling Trott Brook being deeded to the City (Outlot A, Covenant Meadows).  The Final Plat was approved with a contingency that Trail Easements over Lots 5 & 6, Block 1 Covenant Meadows, 17362 and 17353 Iodine Street respectively (the "Subject Properties") be deeded to the City.  The Trail Easements would ensure future public access to the open space created by Outlot A.  

It was recently discovered that those Trail Easements were never recorded.  Staff has worked with the Developer, Mr. Eric Thomsen, to resolve this matter.  The Developer subsequently worked with the property owners of each of the respective lots to secure the Trail Easements and has provided both to the City.  The City Council needs to formally accept these Trail Easements before the documents can be recorded.

Notification is not required.

Funding Source:

This is being handled as part of Staff's regular duties.

Recommendation:

Staff recommends accepting both Trail Easements.

Action:

Motion to adopt Resolution #22-046 accepting Trail Easements over portions of 17353 and 17362 Iodine Street NW, satisfying a contingency of the Final Plat approval of Covenant Meadows in 2017.
