Title
Adopt Resolution #22-048 Approving a Development Agreement and Stormwater Maintenance Agreement Related to a Proposed Building Expansion at 7060 143rd Avenue NW (Project No. 22-105); Case of Viking Mold Inc.
Purpose/Background:
The City is processing a Building Permit Application from Viking Mold Inc. (the "Applicant") for a proposed 7,550 square foot building addition on their existing property located at 7060 143rd Avenue NW (the "Subject Property"). Note that T & C Enterprises L.L.C. is actually the fee title owner of the Subject Property. The proposed addition meets all bulk standards of the E-2 Employment District and thus qualifies for an Administrative Site Plan review (civil plans reviewed as part of Building Permit submittal, rather than being routed through Planning Commission and City Council). However, a Development Agreement is still needed to address the Financial Surety and Inspection Fee collected for all developments to ensure the site improvements are installed in accordance with approved plans. In this instance, a Stormwater Maintenance Agreement is also needed as the proposed additional impervious area requires onsite stormwater management (ponding).

No notification is required.
Observations/Alternatives:
The Applicant is proposing a 7,550 square foot building expansion along the south side of their existing 16,000 square foot building. Along with the building addition, there will be approximately 25,000 square feet of additional paving installed as well. The additional impervious surfacing requires onsite management of stormwater. The project does propose a stormwater pond along the southern boundary of the Subject Property. However, there are no drainage and utility easements in this area. Thus, a Stormwater Maintenance Agreement has been drafted that outlines the long-term maintenance and cost responsibilities.
A standard Development Agreement is also needed to address the typical Financial Surety and Inspection Fee that are collected prior to construction. These are both intended to ensure that the site improvements (e.g. stormwater improvements, grading, paving, erosion control, landscaping, etc.) are installed in accordance with approved plans. No development fees are applicable as no new, buildable lots are proposed.

Funding Source:
Staff is handling this as part of our regular duties. Recording of these two agreements will be the Applicant's responsibility.
Recommendation:
Staff recommends approving both the Development Agreement and the Stormwater Maintenance Agreement.

Motion to adopt Resolution #22-048 approving a Development Agreement and Stormwater Maintenance Agreement for Viking Mold Inc.'s building expansion project at 7060 143rd Avenue NW.
