Title:
Review Draft City Administrator Contract
Purpose/Background:
These sections of the current contract were discussed at the previous work session meeting:
Termination and Severance Pay.The CITY at any time may terminate this agreement
with or without cause. In the event EMPLOYEE is terminated by the COUNCIL during such time that EMPLOYEE is willing and able to perform his duties under this agreement, then in that event the CITY agrees to pay EMPLOYEE his then current salary and benefits for a period of three (Note: four months and six months are also common - Six months is the most allowed by Minnesota law). At the time of the EMPLOYEE’S one year performance review, pending satisfactory performance, the COUNCIL may consider an adjustment to EMPLOYEE’S severance pay.
Resignation. In the event EMPLOYEE voluntarily resigns his position with the CITY, then EMPLOYEE shall give the CITY a 45-day (Note: 30-day and 60-day notice periods are also common) prior written notice.
Dues, Subscriptions and Professional Development. The current City Administrator contract specifies organizational membership as well as types of professional development. A reasonable option is to allocate a fixed amount and leave those specific activities to the discretion of the City Administrator. If this option is chosen, an amount of $5,000 would be an initial allocation to be included in the contract. Note, inflation will erode this number over time and the candidate may have specific development needs that they would like to negotiate.
Other issues such as salary, vacation, sick leave, car allowance, health/dental insurance and deferred compensation are all negotiable items that can be considered as part of the compensation package.
