Title
Adopt Resolution #22-131 Accepting Deed for Outlot A Lynwood Addition
Purpose/Background:
The City Council approved the Final Plat of Lynwood Addition on February 22, 2022. A condition of that approval was that the Lennar (the "Applicant") provide either a twenty (20) foot wide Trail Easement within Outlot A or deed the entirety of Outlot A to the City. One or the other is critical as the City continues to work toward a complete trail corridor connecting The COR and Lake Itasca (aka Lake Itasca Greenway).

Notification is not required.
Observations/Alternatives:
The Applicant is proposing to deed both Outlot A and Outlot Q to the City. Outlot A is a combination of wetland and upland and will remain undisturbed throughout the construction of Lynwood Addition. Accepting fee title to Outlot A allows the City to continue working toward a complete trail/greenway corridor between The COR and Lake Itasca. Furthermore, as it will be left undisturbed, additional maintenance activities will not be required.
Outlot Q, however, includes one of the main stormwater basins for Lynwood. This outlot is encumbered with drainage and utility easement. Therefore, the City will be responsible for long-term maintenance of the stormwater basin to ensure functionality, which is standard. However, if the City were to accept fee title to this outlot, the City would also have to take on more routine maintenance, such as mowing and litter/debris clean-up and removal. Presently, there is not sufficient staff capacity to take on this additional maintenance and thus, Staff is recommending only accepting fee title to Outlot A.

Funding Source:
The Applicant is responsible for all costs associated with this project.
Recommendation:
