Title
Adopt Resolution #22-153 Approving Easement Agreement with PSD, LLC for Riverdale Drive Extension, Llama Street to Bowers Drive, Improvement Project #20-05
Purpose/Background:
Purpose:
A perpetual drainage and utility easement is needed over, under and across property owned by PSD, LLC to construct the proposed trunk watermain loop between Riverdale Drive and Bunker Lake Boulevard as part of Improvement Project #20-05.
Background:
Riverdale Drive is proposed to be extended from Llama Street to Bowers Drive this Fall under Improvement Project #20-05. This project also proposes to construct a trunk watermain loop between Riverdale Drive and Bunker Lake Boulevard, which requires crossings under Highway 10 and the Burlington Northern Sante Fe (BNSF) Railway. A permit for the BNSF Railway crossing has been obtained and is attached for reference, and plans have been approved by the Minnesota Department of Transportation (MnDOT).
Upon Council approval of the attached perpetual drainage and utility (D&U) easement agreement, the City can construct the proposed trunk watermain loop and have perpetual access to maintain the trunk watermain within the D&U easement.
Attached is a copy of the executed perpetual drainage and utility easement agreement with PSD, LLC. Exhibit A of the attached agreement includes a graphical representation of the D&U easement area.
Upon receiving City Council approval, the easement agreement will be recorded with Anoka County, and PSD, LLC will be provided with a copy of the recorded agreement.

Funding Source:
As required by the easement agreement, a sum of $1.00 will be paid to PSD, LLC from the water utility fund.
Recommendation:
Staff recommends adopting Resolution #22-153.
