Title:
Clarify Park Dedication Requirements for Trott Brook Crossing
Purpose/Background:
At the regular October 2021 Park & Recreation Commission meeting, the Commission affirmed the Park Dedication and Trail Fees owed for the Trott Brook Crossing plat. At the time, and at City Council's approval of the Preliminary Plat, it was understood that the approximate five phases of the plat would occur from the east (at Nowthen Boulevard) and progress to the west at Variolite Street. Accordingly, the Commission's recommendation to Council was that the land (with historic farm buildings) would first solve for the Park Dedication owed, with the balance of cash owed in subsequent phases. The same was true for the Trail Fees, in that the Developer was to construct trail and boardwalk, and the remaining cash owed would be applied to later phases.
The past month the City learned that the Developer is planning on filing for Final Plat approval essentially in reverse order, with the first phase off from Variolite Street. (Please see the attachment for the expected phasing plan, submitted by the Developer.)

Observations/Alternatives:
The essence of this case is to inform the Commission, that with the filing of the Final Plat, staff with be formulating the Development Agreement with the full cash Park Dedication and Trail Fees owed for each lot platted, until the Developer conveys the intended land to the City and constructs the trails and boardwalk.
Funding Source:
No funding is required, rather this case addresses the collection of Development Fees, specifically Park Dedication and Trail Fees.
Recommendation:
Staff recommends acknowledging by Motion or consensus that the Development Agreement will specify Park Dedication and Trail Fees in the full cash amount for each lot created until such time as the park land is acquired by the City, and trails and boardwalks are completed within the proposed Trott Brook Crossing.
Action:
Motion (or consensus) to direct Staff to prepare the Trott Brook Crossing Development Agreement for City Council's consideration, specifying that Park Dedication and Trail Fees shall be due in the full cash amount for each lot created until such time as the park land is acquired by the City, and trails and boardwalks are completed.
