Title:

PUBLIC HEARING - Easement Vacations in HY-10 RAMSEY

Purpose/Background:

The existing plat of "HY-10 Ramsey" has several platted drainage and utility easements that are proposed to be vacated.  Some of these easements will be re-established with the proposed plat of "ARAA Subdivision."  Some of the easements contain private utilities and are located in areas where easements will be re-established with the proposed plat.  The applicant is also working with Connexus Energy about revising private utility easements on the site.  

Notification:

Notification was provided in the January 13, 2023, Anoka County UnionHearld newspaper.  Mailed notices were sent to properties within 700 feet of the site.  A "proposed development" sign was placed at the site fronting Ferret Street.  All of the utility companies were provided a copy of the notice.  

Time Frame/Observations/Alternatives:

Staff recommends approving the easement vacation conditioned upon recording the proposed plat of "ARAA Subidvision" to ensure protection of existing utilities.  

Alternatives:
1.  Approve the easement vacation as recommended by staff.
2.  Approve the easement vacation with any modifications the Council desires.
3.  Deny the easement vacation based on certain findings leaving the existing easements in place.

Funding Source:

All costs associated with this application are the responsibility of the applicant.  

Recommendation:

Staff recommends approving Resolution #23-027 Approving Vacating Easements in Hy-10 Ramsey.

 

Outcome/Action:

Motion to waive the Charter provision of reading the resolution aloud and adopt Resolution #23-027 approving vacating easements in HY-10 Ramsey.
