Adopt Resolution #23-050 Approving a Development Agreement and Stormwater Maintenance Agreement at 6710 Highway 10 NW (Project No. 22-106) ; Case of Blue Line Collision

The purpose of this case is to review a request from Reliable Auto Collision Experts (the "Applicant") for a development agreement associated with a previously-approved Site Plan, Easement Vacation and Conditional Use Permit (approved September 13, 2022). This is the standard last step in the development process. The Site Plan, Easement Vacation, and Conditional Use Permit met all City Code requirements, and the attached Development Agreement is based on the City's standard template, which has been reviewed by the City's Attorney. The development agreement lays out fees, project costs, and financial sureties that the City will take in order to ensure that the project is completed to City standards.

The project does propose a private stormwater pond along the eastern boundary of the Subject Property due to additional impervious surface area for the automotive repair center. However, there are no public drainage and utility easements around the pond. Thus, a private Stormwater Maintenance Agreement has been drafted that outlines the long-term maintenance and cost responsibilities.

No notification is required. 

The Applicant is responsible for all costs associated with review.
