Title
Adopt Resolution #23-060 approving the Final Plat and Development Agreement for "Trott Brook Crossing"
Purpose/Background:
Twin City Land Development has submitted the final plat for the first phase of Trott Brook Crossing. The 52-lot first phase is at the west end of the development. This first phase is anticipated to meet the needs of the builder for 2023 and 2024 as street and utility construction will take up much of the summer.
The proposed plat is consistent with the approved preliminary plat that was approved by the City Council on January 11, 2022. Subsequently, the Metropolitan Council has approved the Comprehensive Plan Land Use change and the City Council approved a grading permit to which the developer has completed rough grading of the western portion of the development.
The plat includes several outlots. Some of the outlots will be created for storm water basins and wetlands that will be owned by the homeowners' association. Some outlots will be reserved for future phases of development. One of the outlots will be deeded to the neighbor to the southwest. One outlot will be deeded to the City for the sanitary sewer lift station.
Another parcel, Lot 1, Block 6, will be used to satisfy some of the park dedication requirements. Cash dedication will be required in future phases. A temporary access easement will be provided since a public road to the park will not be dedicated or built until a future phase of the development.
The Development Agreement (DA) is also proposed for the first phase. Generally speaking, a DA is written based on the approval(s) the Council previously granted. The DA spells out the expectation that the work to develop the site will be done according to the approved plans, in a timely manner, and according to City rules. If not, financial sureties will be cashed in to correct or clean up the work. The DA also provides credit and reimbursements for oversizing and over-depth of sanitary sewer lines to serve properties beyond the plat's boundaries. It states that the property being deeded for park dedication will be delivered clean and intact.
The DA also allows for five model home permits. Staff has agreed to work with the builder on five lots directly adjacent to Variolite Street that can have access for the homebuilder to begin working on the model homes with minimal interference to the street and utility crews working on the site. These locations are acceptable to the public safety departments based on the access and that there are existing fire hydrants close by on Variolite Street.
The developer had been grading the site in the fall of 2022. Staff has not received any complaints of improper work occurring and has been satisfied with the work conducted to date.

Notification:
No direct public notification is required for final plat approval.
Funding Source:
All costs associated with processing this application have been paid by the developer.
Recommendation:
Staff recommends approval of the resolution for the final plat and development agreement consistent with previous Council approvals.
Alternatively, the City Council could make modifications to the plat and/or the DA that are consistent with previous approvals that the Council would like.
Denial of the final plat and DA would need to meet a high threshold of findings as entitlements are seen as granted at the preliminary plat stage.

Action:
Motion to waive the Charter provision of reading the resolution aloud and adopt Resolution #23-060 approving the Final Plat and Development Agreement for "Trott Brook Crossing."
