Title:
Adopt Ordinance #23-11 Granting Centerpoint Energy Nonexclusive Franchise and Public ROW Access
Purpose/Background:
On May 23, 2023, City Council introduced Ordinance #23-11, Granting Centerpoint Energy Nonexclusive Franchise and Public ROW Access.
Adopted Ordinance #03-16 Granting Centerpoint Energy Nonexclusive Franchise and ROW Access became effective on August 11, 2003 for a term of twenty (20) years. The ordinance is set to expire August 11, 2023. Proposed Ordinance #23-11 will replace the existing ordinance and have a term of twenty (20) years, expiring on July 16, 2043.
Centerpoint Energy has been part of the ordinance process and supports the draft language and term.

Notification:
The proposed ordinances does not require a public hearing or notification.
Time Frame/Observations/Alternatives:
Once approved, the Ordinance will be published on June 16, 2023 for a period of thirty (30) days. The Ordinance will be effective on July 16, 2023.

Funding Source:
This ordinance is being handled as part of normal staff duties. Also, any time work is completed, the City collects a right-of-way permit fee from Centerpoint. In 2022, the City collected $1,755. 2023 fees are as follows:
Boring/Open Trench $95 + $15 per driveway
Road Closing $20
Bond Per Mile $10,000

Recommendation:
Staff recommends City Council adopt Ordinance #23-11.
Outcome/Action:
Motion to waive the City Charter requirement to read the ordinance aloud and to adopt Ordinance #23-11, Granting Centerpoint Energy Nonexclusive and Public Right-of-Way Access.
