Title:

Receive Recommendation from the Charter Commissions to Amend Chapter 4 of the Charter - Nominations and Elections

Purpose/Background:

Background:
Council previously reviewed and voted on Ordinance #23-07 to amend sections 4.5.4 and 4.5.6 of the Charter. That ordinance did not pass. On May 9, 2023, Council discussed language that would be acceptable to update sections 4.5.4 and 4.5.6. The Charter Commission met on July 19, 2023 to review options to update those two sections and ultimately approved proposing the language in Ordinance #23-08.  

Purpose:
The purpose of this case is to receive the recommendation from the Charter Commission to Amend Chapter 4 of the City Charter. 
The recommended changes are to amend Chapter 4 of the City Charter sections 4.5.4 and 4.5.6. The changes proposed allow the option to appoint a successor in the case of a vacancy until a successor is elected or with less than 365 days left in the term. In order for the appointment to be approved, it must receive unanimous support from all current Councilmembers.

Within one month of receiving a recommendation to amend the charter by ordinance, the city must publish notice of a public hearing of the proposal. The city must hold the public hearing on the proposed charter amendment at least two weeks, but not more than one month after the notice is published. Within one month of the public hearing, the city council must vote on the proposed charter amendment ordinance. To pass, the vote must be unanimous, including approval by the mayor.

Next Steps: 
  • Per State Statute 410.12 Subd. 7., the Council must vote on the proposed charter amendment ordinance within one month of the public hearing. 
  • Publish Public Hearing Notice on August 25, 2023. 
  • Hold Public Hearing and Introduce Ordinance #23-08 on September 12, 2023. 
  • The Ordinance will come back for final consideration on September 26, 2023. 

Recommendation:

City Charter recommends adoption of the ordinance.

Outcome/Action:

No action is required at this time.
