Title:
Introduction of Ordinance #23-16 Amendment to Chapter 26, Article XIV. Rental Residential Dwelling Units.
Purpose/Background:
At the January 24, 2023 City Council work session, there was a discussion on crime-free housing as part of the strategic plan. At that time, staff was to move forward to discuss crime-free housing and an inspection program at a future work session.
At the February 14, 2023 work session, crime free housing and an inspection program were discussed; staff was directed to draft a rental housing inspection ordinance, along with associated fees needed for the implementation of the program.
At the March 28, 2023 work session, staff brought forward a draft ordinance that was discussed in detail. At that time, the City Council directed staff to come back to discuss proposed fee amounts to cover the implementation of the program.
At the July 25, 2023 work session, rental license fees were discussed and staff was given direction to prepare fees for the 2024 Fee Schedule to cover the costs associated with a rental inspection program and to require the annual renewal of rental licenses.
If a crime free housing and rental inspection program is formally adopted by City Council, as part of the inspection program, a rental housing inspector will be hired in 2024. Staff recommends the inspector be hired later than April 2024. This will allow the Code Enforcement Officer to train the inspector for approximately a month before the regular nuisance code issues increase, and the Code Enforcement Officer will then be focusing on those duties.

Notification:
If the ordinance is adopted in September 2023, rental license holders will be notified of the changes that will be effective on January 1, 2024.
Time Frame/Observations/Alternatives:
If the ordinance is introduced, it will be placed on the September 12, 2023 City Council for formal adoption or denial. If adopted, the ordinance will be published for 30 days and will become effective on January 1, 2024.

Funding Source:
Annual rental license fees will be collected. Annual fees will be approved as part of the 2024 Fee Schedule and will become effective January 1, 2024. The annual license fees collected will be approximately $200,000.00 to cover the costs of the rental inspections program; including staff time of the rental inspector, police, fire, inspection vehicle, miscellaneous equipment and all other associated fees.
Recommendation:
Staff recommends the City Council introduce Ordinance #23-16, Amendment to Chapter 26, Article XIV. Rental Residential Dwelling Units.
