Title:
Winkelman Solicitor License
Purpose/Background:
Mr. Winkelman has requested to address the city Council.
Mr. Winkelman has expressed frustration about not being able to receive a solicitor license for the purpose of selling puppies near the Game Fair Event annually held in August over two separate weekends. The dates in 2023 are August 11, 12, 13, 18, 19 and 20.
Chapter 26, Article XIII of our City Code requires Peddlers, Solicitors and Transient Merchants to obtain a license prior to conducting business, with approval occurring by the City Council. Late in 2022, staff met to discuss the situations where licenses are requested by applicants to be issued on the spot due to time constraints between when they hope to do business versus when the next Council meeting is scheduled. On multiple occasions, these situations occur due to a code enforcement interaction. As part of the application, a background check is conducted and a staff recommendation is provided to the City Council for consideration. Staff typically processes these requests quickly, however, by following the process staff is able to ensure the proper back grounding is conducted. Historically, there have been times when licenses were issued and business was allowed to be conducted prior to Council consideration. Knowing what has been allowed in the past, staff proactively emailed nearly 100 addresses associated with licenses in the past. Staff further felt an email would be a sufficient means of communication given the regularity email is used. This email was sent in May 2023 prior to the warmer weather months when these licenses are often requested. Within that email, staff specially noted a July 18, 2023 application deadline for licenses associated with the timing of Game Fair. This deadline would have allowed proper back grounding to occur, and City Council consideration at the August 8, 2023 meeting. It should be further noted that a city is not required to send a notice of this nature, and the responsibility falls on the applicant to properly obtain the license.
Attached is the email that was sent to 93 email addresses pulled from past licenses.
