Title:

Adopt Ordinance #23-08 to Amend Chapter 4 of the Charter - Nominations and Elections

Purpose/Background:

BackgroundCouncil previously considered Ordinance #23-07 to amend sections 4.5.4 and 4.5.6 of the Charter. That ordinance did not pass. On May 9, 2023, Council discussed language that would be acceptable to update sections 4.5.4 and 4.5.6. The Charter Commission met on July 19, 2023 to review options to update those two sections and ultimately approved proposing the language in Ordinance #23-08, which mirrors language supported by the City Council at the May 9, 2023 work session.

Purpose:
The purpose of this case is to vote on the proposed amendments to the Charter in Ordinance #23-08.
The recommended changes are to amend Chapter 4 of the City Charter sections 4.5.4 and 4.5.6. The changes proposed allow the option to appoint a successor in the case of a vacancy until a successor is elected or with less than 365 days left in the term. In order for the appointment to be approved, it must receive unanimous support from all current Councilmembers.

Within one month of receiving a recommendation to amend the charter by ordinance, the city must publish notice of a public hearing of the proposal. The city must hold the public hearing on the proposed charter amendment at least two weeks, but not more than one month after the notice is published. Within one month of the public hearing, the city council must vote on the proposed charter amendment ordinance. To pass, the vote must be unanimous, including approval by the mayor.

Notification:

The City Council received the recommendation from the Charter Commission on August 22, 2023. The Public Hearing was held on September 12, 2023.

Time Frame/Observations/Alternatives:

Per State Statute 410.12 Subd. 7., the Council must vote on the proposed charter amendment within one month of the public hearing.
