Title:
Adopt Ordinance #23-20, Amendment to Chapter 26, Licenses, Permits, and Miscellaneous Business Regulations, Article XVI. Tobacco, Division 2, Section 26-787(6)
Purpose/Background:
On November 14, 2023, the City Council introduced Ordinance #23-20, amending Chapter 26, Article XVI. Tobacco, Division 2, Section 26-787(6). The ordinance amends the city code to allow only one (1) tobacco license to be issued for any given location or address.
Recently, city staff received two (2) tobacco license applications for the same address; one application was for the existing tenant and the other application was for a new tenant. Staff had not encountered this issue before and the City Code does not specifically address the number of tobacco licenses allowed for each property. After consulting with the City Attorney, it was determined to amend the code to allow only one (1) tobacco license per location or address.

If the City Council adopts Ordinance #23-20, then the ordinance will become effective 30 days after publication.

Recommendation:
Staff recommends the adoption of Ordinance #23-20.
Outcome/Action:
Motion to waive the City Charter requirement to read the ordinance aloud and to adopt Ordinance #23-20, Chapter 26 Licenses, Permits, and Miscellanious Regulations, Article XVI. Tobacco, Division 2, Section 26-787(6).
