Adopt Resolution #24-032 Approving Joint Powers Agreement with the City of Nowthen regarding the 2024 NE Ramsey Street Reconstructions, Improvement Project #24-03

Purpose/Background:

Purpose:
The purpose of this case is to adopt Resolution #24-032 approving the attached Joint Powers Agreement (JPA) with the City of Nowthen for completing public improvements related to the street reconstructions of 182nd Lane, Ventre Street, Waco Drive and Waco Street as part of the 2024 NE Ramsey Street Reconstructions, Improvement Project #24-03.
 
Background:
City of Ramsey Improvement Project #24-03 proposes to reconstruct the streets within Ford Brook Estates 3rd, Rodeo Hills Estates, Valley View Acres, and Section 01 Unplatted north of CR 27 subdivisions. The streets within Section 01 Unplatted include Waco Street and Waco Drive, both of which extend into the City of Nowthen. The City of Nowthen is proposing to partner with the City of Ramsey on this project to reconstruct the portions of Waco Street and Waco Drive within their City limits, along with 182nd Lane and Ventre Street in 2024. The location and scope of the proposed improvements are shown in Exhibit A.
 
The City of Ramsey is proposed to be the lead agency for this project since the Ramsey project is considerably larger than the City of Nowhens’ project. As outlined in the attached JPA, Ramsey shall bid the project, contract with contractors and administer construction for the project. The City of Nowthen shall be responsible for all construction costs and indirect project costs for work occurring within the City of Nowthen, including construction inspections and materials testing of improvements.
 
The City of Ramsey is proposed to pay all partial and final construction costs for the project. Nowthen agrees to repay its share of the project costs to Ramsey on a net 30-day basis following Ramsey payment to contractors. Nowthen’s share of the final costs include the final required engineering design costs, construction costs, and inspections costs required to construct the improvements within the Nowthen City limits. Nowthen shall be providing a set of plans, which will be combined with the City of Ramsey plans and bid as an A + B project.
 
The attached JPA sets forth the obligations of each City in regards to constructing and funding the project. Ramsey’s City Attorney has reviewed and approved the attached draft JPA, as has the City of Nowthen’s Staff and City Attorney. The City of Nowthen’s City Council has approved the draft JPA. Upon approval by the Ramsey City Council, the supporting resolutions from each City will be added to the JPA as Exhibits B and C.
 
On August 22, 2023, Ramsey City Council Resolution #23-199 accepted the proposal from Hakanson Anderson to prepare final plans and specifications for 2024 NE Ramsey Street Reconstructions, Improvement Project #24-03. Hakanson Anderson is currently working on plans and specifications for these improvements. The JPA does not cause significant alteration to the City of Ramsey construction plans or designs.

Observations/Alternatives:

Observations:
There is a benefit to both Cities to have one Contractor perform the work. This avoids complexities of having multiple contractors and potentially sub-contractors on differing timelines which could affect the progress of construction, and have negative impacts to the adjacent property owners and traveling public.
 
The City of Ramsey is proposed to lead the project since the Ramsey project is approximately 75-percent of the proposed work. Approval of the JPA should not have a significant impact to the construction timeline for the City of Ramsey improvements. Not approving the JPA could have a negative impact to the construction timeline, though it’s not possible to know at this time what the full extent of the impact would be.
 
Alternatives:
Motion to adopt Resolution #24-032 approving the attached Joint Powers Agreement (JPA) with the City of Nowthen for completing public improvements related to the street reconstructions of 182nd Lane, Ventre Street, Waco Drive and Waco Street as part of the 2024 NE Ramsey Street Reconstructions, Improvement Project #24-03.

Funding Source:

The JPA does not identify specific costs, but rather obligates the City of Ramsey to funding the improvements within the Ramsey City limits, and obligates the City of Nowthen to funding the improvements within the Nowthen City limits. The JPA allows the City of Nowthen to review the bids prior to acceptance and if they choose not to proceed with the improvements due to pricing, the alternative bid for the City of Nowthen improvements will not be awarded to the low bid contractor.

Recommendation:

Staff recommends adopting Resolution #24-032 approving the attached Joint Powers Agreement (JPA) with the City of Nowthen for completing public improvements related to the street reconstructions of 182nd Lane, Ventre Street, Waco Drive and Waco Street as part of the 2024 NE Ramsey Street Reconstructions, Improvement Project #24-03.

Action:

Motion to adopt Resolution #24-032 approving the attached Joint Powers Agreement (JPA) with the City of Nowthen for completing public improvements related to the street reconstructions of 182nd Lane, Ventre Street, Waco Drive and Waco Street as part of the 2024 NE Ramsey Street Reconstructions, Improvement Project #24-03.
