Adopt Ordinance #24-05, An Ordinance Amending Ordinance #23-09, An Interim Ordinance Prohibiting the Establishment of New Uses or the Operation of an Adult-Use Cannabis Business Related to the Sales, Testing, Manufacturing and Distribution of Real THC Products

On March 26, 2024, a public hearing was held at the City Council meeting to introduce Ordinance #24-05. There were no public comments.

Ordinance #24-05 prohibits the establishment of new uses or the operation of adult-use cannabis businesses related to the sales, testing, manufacturing and distribution of real THC products until January 1, 2025. For the remainder of 2024, city staff will be working with the Office of Cannabis Management (the Office) to develop ordinances, processes and forms needed prior to the issuance of adult-use cannabis licenses and registrations. At this time, the Office estimates the first adult-use cannabis licenses can be applied for on January 1, 2025.

Notification is not required for the adoption of the ordinance.

Once the interim use ordinance is adopted, it will remain in effect until January 1, 2025, or until the City Council determines proper regulations are in place for the sale of adult-use cannabis, whichever comes first.

Alternatives Include:
1. Adopt Ordinance #24-5 as presented;
2. Adopt Ordinance #24-05 with modifications;
3. Table the adoption for more discussion at a work session; or
4. Deny the ordinance
