Adopt Resolution #24-129 Approving Community Benefit Agreement with iDigital Outdoor, LLC, at 9500 Hwy 10 NW.

On July 11, 2023, the City Council approved iDigital's request for a conditional use permit (CUP) for an off-premise digital billboard.  The approved location of the sign is on the Nathe property south of Highway 10 opposite Alpine Dr. NW.  One of the requirements of City Code for this type of sign is a community benefit agreement for certain types of messages from the City:

Applicants for an off-premises digital billboard signs permit shall enter into an agreement with the city to provide the city no less than 20 hours (provided in 9,000 eight-second spots) per month per dynamic display off-premises sign face in the city for community and public service messages at such times as shall be reasonably determined by the city. This agreement must be approved by the city council before a permit for the construction or conversion of an off-premises signs and digital billboard may be issued by the building official.

The attached agreement fulfills the requirement of City Code and the CUP.  Once approved and signed, a building permit can be issued for the billboard.  

None required.  The standard notification procedure was made in 2023 as part of the conditional use permit process.  

Alternatives to consider.
1. Approve the agreement as proposed.
2. Make modifications to the proposed agreement.
3. Deny the agreement based on certain findings. 

All costs associated with this project are the responsibility of the applicant.  

Staff recommends approving the community benefit agreement.
