Title:
PUBLIC HEARING: Adopt Resolution #24-176 and #24-177 Vacating Drainage and Utility Easements and Approving a Final Plat and Stormwater Maintenance Agreement for Diamond Graphics at 14350 Azurite St NW (Project No. 24-111); Case of Diamond Graphics
Purpose/Background:
The City has received a Land Use Application from Diamond Graphics (the "Applicant") for an Easement Vacation and approval of a Final Plat for Sunfish Lake Business Park Fifth Addition to accommodate a building addition and parking lot expansion at 14350 and 14280 Azurite Street (the "Subject Property").
Notification:
Staff attempted to notify property owners within 350 feet of the Subject Property, as reflected in the Anoka County Property Records, as well as the small utility companies, of the request for the vacation of all existing drainage and utility easements on the Subject Property and the Public Hearing to be held by the Planning Commission. A notice of the Public Hearing was published in the Anoka County UnionHerald, the City's official newspaper. A proposed development sign was placed on the Subject Property as well.
Observations/Alternatives:
Project Overview
The Applicant is proposing a 68,000 square foot building expansion, as well as an expansion of the parking and maneuvering areas on the Subject Property. The building expansion would have resulted in the building spanning a common lot line between 14350 and 14280 Azurite Street, both owned by the Applicant. Thus, the Applicant has submitted a Final Plat to combine the two parcels into a single, buildable lot. Vacating all existing drainage and utility easements on the Subject Property and re-dedicating them with the recording of the Final Plat is the cleanest and simplest process. Since the Subject Property is not adjacent to any residential uses, the building expansion and associated improvements qualify for administrative review. Therefore, the Site Plan will be reviewed as part of the Building Permit Application submittal.
Easement Vacation
Staff notified all small utilities regarding the requested easement vacation. Responses have been received from Centerpoint Energy, Comcast, and Zayo, stating that they have no objection to the requested easement vacation (they do not have any facilities within the easements currently). Additionally, new drainage and utility easements will be dedicated where needed with the recording of the Final Plat of Sunfish Lake Business Park Fifth Addition (the "Plat"). Approval of the Easement Vacation would be contingent upon recording of the Plat.
Final Plat
The Plat combines the two parcels owned by the Applicant into a single, buildable lot. The Plat eliminates the common lot line between the two parcels, which is necessary for the planned building expansion. Staff is working with the Applicant to revise the Plat to eliminate the proposed drainage and utility easement over the new stormwater basin in the southeast corner of the Subject Property. The stormwater basin will not receive stormwater from other properties or from public roads, meaning it serves as a private stormwater basin. There is no need to encumber it with drainage and utility easement, which would make it the City's responsibility for long-term maintenance. Instead, the City has drafted a Stormwater Maintenance Agreement, which, if approved, would be recorded along with the Plat. The Stormwater Maintenance Agreement outlines the responsibilities of the Applicant to maintain the stormwater basin and associated infrastructure.

Funding Source:
All costs associated with this request are the responsiblity of the Applicant.
Recommendation:
Staff recommends approving the Easement Vacation, Final Plat, and Stormwater Maintenance Agreement associated with this project.

Motion to adopt Resolution #24-176 vacating all existing drainage and utility easements on the Subject Property.
