Adopt Resolution 24-194 Approving Change Order No. 1 to AET Proposal for Improvement Project #21-09, Centralized Water Treatment Plant

On March 28, 2023, the City Council awarded a construction contract to Magney Construction, Inc. in the amount of $31,528,500.00 for the centralized Water Treatment Plant. That same day, the City Council accepted an amendment from the design engineer, Advanced Engineering and Environmental Services (AE2S), in the amount of $225,100.00 to provide additional construction phase services for the Water Treatment Plant.

On April 25, 2023, the City Council approved Proposal No. P-0021454 from American Engineering Testing, Inc. (AET) with an estimated fee of $35,335.00 to perform special inspections and construction testing services for the centralized Water Treatment Plant.

AET recently identified that their invoiced costs to the City were fast approaching their estimated fees but that construction was generally only half complete. Upon further review, AET identified that the cost estimate included in their proposal was incorrectly calculated using a concrete testing rate of 1 test per every 100 cubic yards of concrete poured, even though their proposal specified a concrete testing rate of 1 test per every 50 cubic yards of concrete poured.  AET then submitted Change Order #1 to Proposal No. P-0021454 to request an additional budget of $15,310.00 to supplement their incorrect estimated fees for construction testing services during the remainder of construction of the Water Treatment Plant.  

Notifications are not required for this case. 

Water Enterprise Funds will pay for the additional project costs estimated at $15,310.

Staff recommends approving Change Order No. 1 to AET Proposal P-0021454.
