Adopt Resolution #24-210 Approving a Final Plat for "GH Ramsey" and a Development Agreement for Take 5 Oil Change (Case of Garage RE LLC)

On July 9th, the City Council approved the Site Plan, Conditional Use Permit, and Vacation of part of a Drainage and Utility Easement for Take 5 Oil Change. Since that meeting took place, the Applicant has submitted a request for a Final Plat of the property to split the lot into two buildable lots in what will be called GH Ramsey Addition in anticipation of a future user on the western portion of the property. The Take 5 lot (Lot 1) will be 0.61 acres, while Lot 2 (to be platted for future development) will be 0.55 acres. Both proposed lots are served by municipal water, sewer, and storm sewer, and both will have access to a shared cross-access easement that connects to both Aldi to the north and Northstar Marketplace to the south and east.

With the plat, site development fees and park dedication are required. Those fees are specified in the Development Agreement, which is attached to this case for City Council's review and approval. Approval of a Development Agreement is a requirement of the development process. The proposed Development Agreement is similar to agreements for other projects, with the addition of language to discuss the construction of an off-site parking lot adjacent to the site, located within the former footprint of Sunwood Drive, to serve the Northstar Marketplace development.

Notification is not required for a request of this nature.

All costs associated with this request are the Applicant's responsibility.

Staff recommends approval of the Final Plat and Development Agreement.
