Title:

PUBLIC HEARING: Adopt Resolution #24-228 Vacating a Portion of Drainage and Utility Easement at 14220 Basalt Street NW (Project No. 24-118); Case of Quad Logic

Purpose/Background:

The City has received a Land Use Application from Quad Logic (the "Applicant") for both a variance and a partial easement vacation on the property located at 14220 Basalt Street NW (the "Subject Property").  The Applicant is proposing a building expansion toward the western property boundary of the Subject Property, which will require a variance for the setback and a partial easement vacation.  The Planning Commission will conduct a Public Hearing at their regular meeting on August 22, 2024, regarding the variance request.  The variance, if granted, is contingent upon successfully vacating a portion of the drainage and utility easement.  This Public Hearing is specific to the request easement vacation.

Notification:

A notification was posted in the July 26, 2024, Anoka Union Herald and emailed notices were sent to the private utility companies operating in Ramsey.  

Time Frame/Observations/Alternatives:

The Applicant is proposing to construct a 3,440 square foot addition on to the west side of their existing building.  Due to the irregular shape of the Subject Property, there is no other feasible way to expand the building without diminishing the drive aisle width, losing parking stalls, and impacting access to the loading docks.  The Subject Property was platted in 1979 with a ten (10) foot wide drainage and utility easement along the western property boundary.  The proposed building addition will encroach slightly into this existing drainage and utility easement along the western property line, which prompted the request for the partial easement vacation.  

Notification of the proposed easement vacation was sent to the private utility companies that operate in Ramsey.  The only response the City received was from Comcast and they indicated they have no infrastructure in the drainage and utility easement.

The City of Ramsey Engineering Department also reviewed the request and have no objection.

Funding Source:

All costs associated with this application are the Applicant's responsibility.

Recommendation:

Staff recommends vacating that portion of the drainage utility easement as depicted in Exhibit 1 within Resolution #24-228. 

Outcome/Action:

Motion to adopt Resolution #24-228 vacating a portion of drainage and utility easement at 14220 Basalt Street NW.
