Adopt Resolution #25-023 Approving Final Payment to North Valley, Inc. for Improvement Project #24-07, 2024 Neighborhood Pavement Overlay Improvement.

Final project costs exceeded the awarded project cost by approximately 6-percent due primarily to a need to replace more concrete curb and gutter than was identified in the plans, and to remove and replace more damaged underlying base course pavement before applying the bituminous wear course pavement overlay.  Staff completes field reviews during the design and plan preparation process in an attempt to accurately identify these pay items within the plans, but sometimes additional damage occurs to infrastructure such as curb and gutter and pavement sections between the time plans are prepared and construction begins, and underlying base course pavement damage becomes much more visible once the wear course pavement is removed.  Staff will continue working to better define such quantity estimates during the design process to help minimize project cost over-runs on future projects.

Issuing final payment will be contingent on receipt of the following items from North Valley, Inc.:

1. IC-134 (Contractor's Withholding Affidavit showing compliance with the provisions of Minnesota Statute 290.92 requiring withholding state income tax).
2. Waiver of Mechanic's Lien Rights (Affidavit that all claims against North Valley, Inc. by reasons of the contract have been fully paid or satisfactorily secured). 
3. Consent of Surety to Final Payment (Certification from the contractor's surety).

Following receipt of these items, final payment will be issued.

The Senior Engineering Technician has inspected the completed work and recommends final payment to North Valley, Inc. for improvement project #24-07, 2024 Neighborhood Pavement Overlay Improvements in the amount of $26,156.47
