Title:

PUBLIC HEARING: Adopt Resolution #25-201 Vacating an Easement in Haubrich Addition. 

Purpose/Background:

This hearing is related to the plat application for Brookside Terrace.  When the Haubrich Addition was platted in 1990, municipal utilities were not available to the site, though they were anticipated within a few years.  With that, the area relied on a natural swale to handle storm water runoff.  This area was covered by a drainage easement.  In 1995, sanitary sewer, water, and storm sewer were installed under 151st Lane and this swale was no longer needed for drainage, and therefore, the platted easement.  The proposed plat of Brookside Terrace will include work to create a storm water basin and swale to accommodate any additional storm water from the new lots and new easements will be dedicated accordingly.  

 

Notification:

Staff notified all of the private utility companies and some provided notice that they have facilities along 151st Lane in the area that will be re-dedicated with the plat of Brookside Terrace.  A "proposed development" sign was placed on the property.  A legal notice was placed in the Anoka Union Herald newspaper.  Mailed notices were provided to surrounding property owners. 

Recommendation:

Staff recommends approval of vacating the easement.

Outcome/Action:

Motion to adopt Reolution #25-201 Vacating an Easement in Haubrich Addition.
