Title:
PUBLIC HEARING: Adopt Resolution #25-218 Vacating Easements and Right-of-Way in Business Park 95 Second and Eighth Additions.
Purpose/Background:
As a part of the replatting of Zero Zone's three parcels into one lot to accommodate an expansion project, some easements need to be vacated in the area where the building expansion will go. With a re-plat of property, it is typically easiest and cleanest just to vacate all the easements and then dedicate new ones in the appropriate places with the new plat. Additionally, a portion of right-of-way for 140th Avenue NW was platted anticipating a roadway extension that never occurred, nor will it be needed since Zero Zone owns all of the land for which the road extension would have provided access.
As a response to the notification, Lumen noted that they may or may not have facilities located somewhere within an easement or easements to be vacated, but were unable to provide as-built plans showing where. The applicant's civil engineering team is working to locate all of the private utilities located on the site.

Notification:
Emailed notices were provided to all the utility companies. Mailed notices were sent to property owners 350 feet from the site. A "proposed development" sign was placed on the property (also for noticing the pending variance request). A legal notice was placed in the Anoka Union Herald Newspaper.

Costs associated with this request are the responsibility of the applicant.
Recommendation:
Staff recommends approval of the vacations.
