Title:

Adopt Resolution #26-042 Authorizing Contract Amendment with H & U Construction for Improvement Project #25-58, Waterfront Waterplay Park Improvements

Purpose/Background:

The purpose of this case is to approve an amendment to the contract with H + U Construction (previously limited to the preconstruction management services) for the Waterfront Waterplay Park Improvements project—with an amendment to the A133-2019 contract for actual construction of the park project as a Construction Manager at Risk (CMAR) with a Guaranteed Maximum Price (GMP) for the water play plaza and associated improvements at The Waterfront. 

Considerable background and detail on this project is included in the attached October 28, 2025, City Council case and attachments.  Due to file size constraints, attachment #6, the Waterfront Draft Drawings, are not included. 


 

Time Frame/Observations/Alternatives:

As indicated, in October 2025, City Council approved a contract with H & U Construction for preconstruction and bidding services—with that work concluding (on time and under budget) with bids received and organized under a proposed amendment to the contract for a GMP of $3,624,184 for the construction of the park project at The Waterfront.

The Bid Tabulation and all other scope and costs included in the GMP are detailed within the first attachment to this case (this document is also referenced within the Resolution as Exhibit A).  Included in the GMP submittal are the recommended owner allowances to be approved for the project that are necessary to complete the construction of the park within the coming months. These are itemized under letter B on page 8 of this first attachment.  It can be clarified here that the totals represented by the GMP and the owner allowances may be thought of as a not-to-exceed amount for the project—portions of contingencies or allowances may not be needed in whole or in part, and therefore any monies unspent, would remain in the Park Trust Fund.

Resolution #26-042 authorizes entering into a contract amendment with H & U as a CMAR with a Guaranteed Maximum Price of $3,624,184 for the water play plaza and associated improvements at The Waterfront—together with an owner's allowance of $128,500, all of which shall be funded from the Park Trust Fund for a total project allocation of $3,752,684.

Additional information will be presented during the meeting. 

Funding Source:

All construction costs and disbursements that this case discusses, would be funded by the Park Trust Fund.

 

Recommendation:

Staff recommends adoption of Resolution #26-042, which authorizes full funding of the water play plaza and associated improvements at The Waterfront—for substantial completion and to be open to the public on July 1st, 2026.

Outcome/Action:

Motion to adopt Resolution #26-042 authorizing a contract amendment with H & U Construction for a Guaranteed Maximum Price of $3,624,184 for Improvement Project #25-58, Waterfront Waterplay Park Improvements—together with an owner's allowance from the Park Trust Fund for a total project allocation of $3,752,684.
