Title:
Adopt Ordinance to Amend City Code Chapter 10-Animals, Article III Dogs
Background:
City staff had a case recently where a citizen wanted to appeal her dog being designated as "potentially dangerous". It was found that our current City Code does not allow for an appeal. Staff has added a section that makes the appeal process for "potentially dangerous" dogs the same as that for "dangerous dogs". Some clarifications were made to the "potentially dangerous" and "dangerous dogs" sections. Staff also has added to the definitions section of this ordinance and made minor revisions that reflect MN State Statutes.
The attached ordinance was introduced at the July 10, 2012 City Council.

Recommendation:
Staff recommends changing the ordinance to allow for appeals of the designation of a dog being deemed "potentially dangerous". Staff also recommends adding to the definitions area of the existing ordinance and making the minor revisions that reflect MN State Statute.
Funding Source:
None required. Staff time only.
Council Action:
Motion to waive the Charter requirement to read the ordinance aloud -AND- adopt Ordinance #12-XXX amending City Code Chapter 10- Animals, Article III Dogs to allow for appeals of the designation of "dangerous dog" and adding additional definitions and wording to the article.
