Title:

Consider Easement Encroachment Agreement for Placement of a Permanent Ground Sign at 14485 Azurite St NW; Case of Wildlife Research Center

Background:

Wildlife Research Center has applied for a Permanent Sign Permit to construct a six foot by three foot (6' x 3') ground sign on the property located at 14485 Azurite St NW.  The proposed sign location is in the front portion of the property just west of the parking lot.  Essentially the entire green space between the parking lot and the front property line is within a drainage and utility easement.  There is a storm sewer line within the easement that needs to be located to ensure there is no conflict between the utility and the proposed sign.   The City Engineer has reviewed the request and has stated that as long as there is no conflict between the existing storm sewer line and the sign location, there should not be any negative impacts on the function of the storm sewer line.

Recommendation:

City Staff recommends approving the Encroachment Agreement to allow for a six (6) foot by three (3) foot ground sign within the drainage and utility easement contingent upon verification that the sign location will not conflict with the existing storm sewer line.

Council Action:

Motion to approve the proposed Encroachment Agreement, subject to final review of the City Attorney as to legal form and contingent upon verification that the sign location will not conflict with the existing storm sewer line.
