Title:

 Change purchase entities for property at 14590 Armstrong Blvd., NW (Wise Choice Liquors).

Background:

 Council is aware that the City has been negotiating for the purchase of the property located at 14590 Armstrong Blvd. NW (Wiser Choice Liquors) (the "Property") from M&W Holding, LLC ("M&W").   As you are also aware, Council Member Jeff Wise is the principal owner of M&W.  State law prohibits a City Council from purchasing real estate from a sitting Council Member.  Mr. Wise is the principal owner of M&W.  To date the City has not executed or concluded any agreements with M&W.  

HRA members will recall that this project was initiated as an HRA project, but changed to the Council under the belief that the Council was the best body to move forward with the public improvement.   It is now recommended that this transaction is best handled by the HRA, because, notwithstanding the above purchase prohibition by the City, state law does permit the HRA to purchase from an HRA Commission Member real property upon compliance with certain statutory requirements.  It should be noted too that the HRA does have authority to purchase the Property pursuant to the 2007 Redevelopment Plan for the Property and adjacent properties.  The objectives of the 2007 Plan include: promote and seek the harmonious development of the Redevelopment Area; to provide logical and organized land use; to promote and provide development of property with minimal adverse impact on the environment; provide adequate utilities and public improvements to enhance new and existing development. These objectives together with others outlined in the 2007 Plan do confirm that the acquisition of the Property is well within the HRA's authority.  

 
Since no agreements have been signed or finalized with M&W for the purchase of the Property, no City Council action is necessary, except to acknowledge that the City will not be purchasing the Property.

Motion to affirm that because of State law restrictions, the City will not purchase from M&W Holdings, LLC the real property located at 145902 Armstrong Blvd., and legally described as Lot 2, Block 1, Hauser Addition, Anoka County, Minnesota.
