Title:

Tree Preservation Ordinance Review

Background:

At the February meeting, the Board reviewed and discussed the current Tree Preservation Ordinance.  As a result of that discussion, there was consensus for Staff to proceed with drafting revisions to remove vagueness where possible (specifically, utilizing the term 'significant tree' rather than 'desirable tree' because the former is already defined in City Code) and to clarify that the existing replacement language is applicable across all zoning districts, not just the multi-family districts.  Additionally, there seemed to be consensus that some flexibility should be incorporated into the regulations that would provide an alternative option (rather than just a variance) if additional trees beyond the established removal threshold were to be removed.  Staff has incorporated language outlining replacement and restitution requirements in an attempt to address this subject.  The proposed revisions are attached for review.

Recommendation:

Review the draft revisions to the Tree Preservation Ordinance, provide any suggested revisions, and direct Staff to prepare an ordinance amendment for consideration by the Planning Commission.

Action:

Motion to direct Staff to prepare an ordinance amendment to incorporate the draft revisions into the Tree Preservation Ordinance and forward the ordinance amendment to the Planning  Commission for a public hearing.
