Title:
Approve Revised Site Plan and Development Permit for McDonald's
Background:
On August 16, 2013, the City received revised plans for the McDonald's project. The plans reflect a slightly reduced building footprint, shortening the length of the building by a total of ten (10) feet (five [5] feet on the north end and five [5] feet on the south end). While this is a minor revision overall, it does represent a change from the approved Site Plan (approved by City Council on January 22, 2013). Also, the Development Permit had indicated a completion date of January 22, 2014 for all required improvements. However, the applicant has yet to close on the purchase of the property from the Housing and Redevelopment Authority (HRA). Within the Real Estate Agreement (REA) with the HRA, the required improvements are to be completed within 720 days of closing on the property. Therefore, the Development Permit has also been revised to reflect a required completion to match that in the REA (720 days from the date of closing on the property). The Attorney has advised that the two documents should be consistent, as the REA date would prevail. Typical store construction would take 180 days.
Observations:
The reduced building footprint does result in a slight reduction in seating; however, the number of parking stalls provided still complies with the standards of the Design Framework. Reducing the building footprint will result in slightly more pervious area (additional sod) on site. There do not appear to be any other significant changes from the originally approved Site Plan.
McDonald's policies are such that they require that the City issue the Building Permit before they will complete the real estate transaction with the City's HRA. A component of allowing Staff to issue the Building Permit is the executing of the Development Permit. The proposed revisions to the Site Plan and Development Permit are fairly minor and, at least with the Development Permit, will mirror certain dates within the REA and thus, it seems reasonable to approve both.
