Title

Adopt Resolution #15-01-017 Approving Dedication of Forcemain from Minnesota Pollution Control Agency

Purpose/Background:

This case is related to the closed Landfill.  Waste Management, Inc. operated the Anoka Regional Mixed Municipal Solid Waste Land Disposal Facility in Ramsey.  Waste Management was required to construct a treated groundwater disposal system to remediate groundwater contamination from the facility.  They entered into an agreement with the City to construct a forcemain from the treatment facility to the City stormsewer located at the intersection of Sunfish Lake Boulevard and Riverdale Drive.  The agreement stated that Waste Management, Inc. would transfer ownership of the forcemain to the City when the groundwater treatment program was finished. Waste Management, Inc. transferred ownership of the line between McKinley Street and Riverdale Drive shortly after the line was constructed. They retained ownership of the line north of McKinley Street.

Waste Management, Inc. executed an agreement in 1997  with the State of Minnesota that  transferred ownership of the landfill facility and associated properties to the State, with the Minnesota Pollution Control Agency (MPCA) responsible for maintaining the property. 

The ground water treatment program ceased operation and the treatment facility was decommissioned.  The City has been requesting transfer of the forcemain from  the MPCA since that time.  The MPCA prepared a dedication agreement in 2014 and submitted it to the City.

Observations/Alternatives:

This line passes through the commercial area located on Azurite Street between McKinley Street and Bunker Lake Boulevard.    The expansion plans of one property were put on hold because the site did not have access to the storm sewer system.  This line passes by the site and can be used for a storm water outlet after the City owns the line, eliminating the need for construction of a pond to contain back-to-back 100 year storms which is the requirement if a storm water outlet is not available.

The agreement was submitted to the county for recording.  They identified 17 properties that would require easements prior to recording the document.  Staff identified easements covering the line by researching county files.  Staff requested a proposal from Hakanson Anderson Associates for preparation of an exhibit showing the existing easements based on the research. 
They provided a proposal for this work with a maximum not to exceed amount of $2,950 which was accepted by staff.  Hakanson Anderson completed the exhibit and staff forwarded the exhibit to Anoka County, who concurred with the findings of the exhibit and is prepared to record the agreement pending Council authorization.

Funding Source:

  This project will be funded through the storm water utility fund.

Recommendation:

Staff recommends approval of the resolution accepting transfer of the forcemain from the MPCA to the City.

Action:

Motion to adopt Resolution #15-01-017 Approving the Dedication/Accepting the Transfer of the Forcemain from the MPCA to the City of Ramsey.
