Title
Approve Receipt of Pedestrian and Bicycle Trail Easement Related to the Plat of Rowe Second Addition; Case of John and Sharon Rowe
Purpose/Background:
On March 24, 2015, the City Council granted Final Plat approval for Rowe Second Addition (originally proposed as Rowe Addition but that plat name already existed). As part of the approvals, the Developer was to provide a fifteen (15) foot wide Trail Easement to the City across Lot 1, Block 1 to accommodate the future construction of a trail. The Developer's surveyor has drafted the legal description of the Trail Easement, which has been been incorporated into a Pedestrian and Bicycle Trail Easement Agreement (attached).
Notification:
Notification is not required to accept a Pedestrian and Bicycle Trail Easement.
Funding Source:
All costs associated with this request are the responsibility of the Applicant.
Recommendation:
Staff recommends approving Resolution #15-05-137 accepting the Pedestrian and Bicycle Easement related to the Plat of ROWE SECOND ADDITION.
Action:
Motion to approve Resolution #15-05-137 accepting the grant of a Pedestrian and Bicycle Easement to the City.
