Title:
Adopt Ordinance to Amend City Code Section 117-118 Related to Front Yard Setbacks in The COR
Background:
The intent of The COR zoning district is to foster a pedestrian friendly, transit oriented development by employing distinctly different standards than other zoning districts within the City. One of the most unique characteristics is a build-to line, setting buildings close to the street. The City has received feedback on numerous occasions regarding the setback requirements in the TC-1 sub-district and its relation to sidewalk requirements. In order to achieve full sidewalk width, sidewalks are required to be partially constructed on private property, thus impacting the amount of separation from the street that can be accommodated.
Throughout the life of the standards set forth for The COR, various minor amendments have been processed to bulk standards and intent of this zoning district. A previous ordinance amended the front yard setback in the TC-4a sub-district from 20 feet maximum to 25 feet maximum. A subsequent ordinance inadvertently reverted back to the 20 foot setback. Current development proposals and building permits are reviewed at the 25 foot standard.
A summary of the proposed changes are as follows:
- Front yard setback in the TC-4 amended from 20 foot max to 25 foot max
- Allows setbacks to be measured from edge of sidewalk easement for properties required to have a portion of a public sidewalk on private property to allow for separation from edge of sidewalk in the TC-1 sub-district.
Notification:
In accordance with State Statute, a public hearing notice was published in the Anoka County Union for the Public Hearing held at the November Planning Commission Meeting.
Recommendation:
Staff recommends approval of the ordinance. The ordinance was introduced at the November 23rd City Council Meeting.
Funding Source:
All costs associated with the ordinance amendment are being handled as part of regular staff duties from the Community Development Fund.
Council Action:
Motion to waive the City Charter requirement read the ordinance aloud -and- adopt the ordinance to amend City Code Section 117-118 Related to Front Yard Setbacks in The COR.
