Adopt Resolution #15-09-230 Ordering Preparation of Assessment Roll and Calling for Assessment Hearing for 2015 Street Maintenance Program Division B, Overlay Improvements; Improvement Project 15-00

Purpose/Background:

Purpose:
The purpose of this case is to adopt Resolution #15-09-230 ordering the preparation of assessment rolls and calling for an Assessment Hearing for 2015 Street Maintenance Program Division B, Overlay Improvements; Improvement Project 15-00.

Background:
As part of the city's long-term Street Maintenance Program, various city streets receive overlay improvements each year to help maximize the life expectancy of street pavement sections. Overlaying streets helps to increase the structural integrity of the pavement sections, while also providing some of the benefits received from crackseal and sealcoat improvements.

The 2015 Street Maintenance Project involved pavement overlays on approximately 3 miles of bituminous surfaced public streets in various locations throughout the City. Attached are Exhibits A through C which show the locations of all streets that received overlays with Division B of the 2015 Street Maintenance Program.

All work is anticipated to be complete by the time the Assessment Hearing is held on October 13th.

Notification:

No notifications are required for this case.  Upon approval of this case, City staff will publish one notice of the hearing in the City’s official newspaper, the Anoka Union Herald, on Friday, September 25th.  Individual notices of the hearing will also be mailed to each property owner proposed to be assessed for the improvements at least 2 weeks before the hearing.

Observations/Alternatives:

Observations:
Anoka County requires that assessments be certified to the County Auditor by the end of November for collection on next year’s taxes.  This deadline will be met by conducting the Assessment Hearing at the October 13th City Council meeting, which will also allow adequate time for the publication and mailing of notices as required per Minnesota State Statute Chapter 429.

Alternative Action #2 – Motion to deny adoption of Resolution #15-09-230 at this time.

Funding Source:

This work is being funded through a combination of Street Reconstruction Bond funds and special assessments.
 
Per the City’s adopted Special Assessments Policy, special assessments amounting to 25% of applicable overlay project costs have been targeted.  The preliminary special assessment amount for all 124 benefiting properties with this year’s project was set at $1,280 per lot which totals $158,720.  However, based on actual project costs the special assessments that will be levied are anticipated to be less than this amount.
 
As part of this project the City Council approved the preparation of a special assessment benefit appraisal consultation to verify that the special assessments would not exceed the benefit to affected properties.  Based on the final special benefit consultation report, it is anticipated that properties benefiting from the improvements and proposed to be assessed will be enhanced in value by approximately $1,700 to $13,000 per property.  Staff will discuss this in more detail during the Assessment Hearing on October 13th.

Recommendation:

Staff recommends Alternative Action #1.
