Adopt Resolution 16 02 039 Authorizing Agreement to Modify Restriction Contained in Deed (McDonalds USA LLC)
Purpose/Background:
The Council provided formal direction to amend existing real estate contracts with McDonald's USA LLC in a regular session meeting on 02/08/2016 . Said real estate contracts are legally recorded against effected properties. In order to make necessary amendments to these contracts, Anoka County (property record manager) is requiring a formal resolution be passed by the City.
The purpose of this case is adopt a formal resolution (outlining the motions the Council passed on 02/08/2016) for recording purposes.
NOTE: specifically, this resolution outlines the construction commencement date change within McDonald's deed from 02/2016 to 09/2016 (completion date remains the same). Please see 02/08/2016 City Council Regular Session Case, Agenda Item 7.2, for details.
