Title

Adopt Resolution #16-05-088 Approving Receipt of Pedestrian and Bicycle Trail Easement in Woodlands 2nd Addition

Purpose/Background:

As part of the approval of the plat known as Woodlands 2nd Addition, U.S. Home Corporation, dba Lennar, ( the "Developer"), was to provide a trail easement to accommodate a bituminous trail connecting 159th Ave and Traprock St.  Attached to the case is the proposed Pedestrian and Trail Easement.

Observations/Alternatives:

The Developer is responsible for the initial construction cost for installation of the trail.  Once accepted by the City, maintenance and repair, as well as snow removal, will be the responsibility of the City (as is typical for all City trails).  The Developer (and all successors and assigns) shall be responsible for maintaining the grass and vegetation within the easement area.

 

Funding Source:

All costs associated with this case are the responsibility of the Applicant.

Recommendation:

City Staff recommends adopting Resolution #16-05-088 authorizing the Mayor and City Administrator to execute the Pedestrian and Bicycle Trail Easement on behalf of the City.

Action:

Motion to adopt Resolution #16-05-088 accepting the trail easement.
