Title:
Adopt Resolution #16-05-103 Approving Final Plat for Brookfield 7th Addition; Case of Capstone Homes (Project No. 16-83)
Purpose/Background:
The City has received an Application for Final Plat Approval for a 27-unit single family development. This proposed Final Plat is a continuation of the Brookfield Development.
Notification:
While not required, Staff has attempted to notify all Property Owners within 700 feet of the Subject Property due to the gap in timing from the review and approval of the Preliminary Plat.
Observations/Alternatives:
The proposed Final Plat is consistent with the approved preliminary plat and generally meets all requirements of the R-1 (MUSA) Zoning District, with only minor modifications as outlined in the Staff Review letter.
When the original Brookfield Preliminary Plat was approved (circa 2004), the surrounding properties were zoned R-1 Residential (Rural Developing), which triggered the requirement for density transitioning along portions of the plat boundary. By the time the current Preliminary Plat was reviewed and approved (as part of the Brookfield 4th Addition), the zoning of the surrounding properties had been amended to R-1 Residential (MUSA) and as such, City Code no longer requires that density transitioning be provided for by the developer. This may allow for the drainage and utility easements shown along the rear lot lines of Block 4 to be reduced if found to be unnecessary for drainage purposes.
Engineering Staff have provided a detailed review letter to the Applicant regarding changes necessary to meet City Code. City Engineering Staff are assessing the size of the proposed drainage & utility easements along the rear of the proposed block 4. If deemed necessary, Staff will work with the applicant to adjust the proposed easements (this would have no impact to the lot configurations or dimensions).
Alternatives
Alternative 1. Adopt Resolution #26-05-103 granting Final Plat approval of Brookfield 7th Addition contingent upon compliance with the Staff Review Letter and the Developer entering into a Development Agreement with the City. The proposed Final Plat is consistent with the approved Preliminary Plat with minor revisions as outlined in the Staff Review letter dated May 18th, 2016. Staff supports this option.
Alternative 2. Do not adopt Resolution #16-05-103. The Developer has completed quality work in the past and the product will be similar to the single family homes constructed in previous Brookfield additions. Staff does not support this alternative.

Funding Source:
All costs associated with processing the Application are the responsibility of the Applicant. At this time, there is no request for public assistance.
Recommendation:
Staff recommends adopting Resolution #16-05-103 granting Final Plat approval of Brookfield 7th Addition, contingent upon compliance with the Staff Review Letter and the Developer entering into a Development Agreement with the City.
Action:
Motion to adopt Resolution #16-05-103, contingent upon compliance with the Planning and Engineering Staff Review Letters dated May 18, 2016 and the Developer entering into a Development Agreement with the City.
