Adopt Resolution #16-06-123 Approving the Development Agreement for Brookfield 7th Addition; Case of Brookfield Land, LLC

On May 24, 2016, the City Council granted Final Plat approval for Brookfield 7th Addition, contingent upon, among other things, the Developer entering into a Development Agreement with the City.  At the time of plat approval, a detailed cost estimate for the Stage I Required Improvements was not available and thus, the Development Agreement included with that case was only in draft format.  The Developer has since submitted a cost estimate for the Required Improvements that has been reviewed and found sufficient by City Staff.  This is important as it is the basis for establishing the surety and inspection fee components of the Development Agreement. 

 

Notification is not required for approving a Development Agreement.

Brookfield 7th Addition consists of twenty-seven (27) single family residential lots. This is the final phase of the previously approved Preliminary Plat.  This phase will include the construction of 167th Crossing, 167th Lane, and Kamacite St as well as installation of municipal water, sanitary sewer and storm sewer utilities.  The Required Improvements are outlined in the attached Development Agreement.  Staff continues to work with the Developer regarding necessary plan revisions before the Final Plat will be released for recording.

All costs associated with processing the request are the responsibility of the Applicant.

Staff recommends adopting Resolution #16-06-123 approving the Development Agreement for Brookfield 7th Addition, subject to review by the City Attorney as to legal form.
