Title:

Adopt Resolution #17-01-024 Authorizing Final Payment to Allied Blacktop Company for IP 16-00: Sealcoats Division A1

Purpose/Background:

Resolution and Pay Request attached.

The amount of the final payment exceeds the contract amount because more cracks were sealed before sealcoating than was anticipated during preparation of estimated costs.  In the future, staff will estimate crackseal quantities by applying greater crackseal quantities on streets having lower PASER ratings.   

Observations/Alternatives:

Issuing final payment will be contingent on receipt of the following items from Allied Blacktop Company:
 
  1. IC 134 (Contractor’s Withholding Affidavit showing compliance with the provisions of Minnesota Statute 290.92 requiring withholding state income tax)
  2. Waiver of Mechanic’s Lien Rights (Affidavits that all claims against Valley Paving, Inc. by reasons of the contract have been fully paid or satisfactorily secured)
  3. Consent of Surety to Final Payment (Certification from the contractor’s surety)
Following receipt of these items, final payment will be issued.

Recommendation:

The Senior Engineering Technician has inspected the completed work and recommends final payment to Allied Blacktop Company for IP 16-00: Sealcoats Division A1 in the amount of $7,676.48.

Action:

Motion to adopt Resolution #17-01-024 authorizing final payment to Allied Blacktop Company for IP 16-00: Sealcoats Division A1 in the amount of $7,676.48.
