Title

Adopt Resolution #17-02-043 Approving an Easement Encroachment Agreement for the Installation of a Ground Sign for the Station; Case of DR Horton

Purpose/Background:

DR Horton (the "Applicant") has applied for a Permanent Sign Permit (the "Permit") for their current project named the Station, located between Ramsey Parkway East, Rhinestone St, 146th Ave, and Peridot St.  The Applicant has proposed installing four (4) stone veneer columns connected with black aluminum powder coated fencing (similar to wrought iron) at the southeast corner of the Subject Property on Lot 49, Block 1 Station (the "Subject Property").  The lettering of the project sign will also consist of aluminum powder coated letters and would be mounted on the aluminum fencing. The proposed location is within a public easement, necessitating this proposed encroachment agreement.

Notification:

Notification is not required when considering an Easement Encroachment Agreement.

Observations/Alternatives:

The sign would be located within a drainage and utility easement on the Subject Property (all common areas on the Subject Property are encumbered with drainage and utility easements).  The proposed signage would be approximately ten (10) feet inside the boundaries of the Subject Property.  It appears to be in a location where there is no storm sewer, sanitary sewer, or water main infrastructure and thus, it does not appear that it will impact any utilities.  The proposed sign location has been reviewed by the Engineering Department and no objections were raised.

The sign itself appears to comply with the standards in The COR Design Framework in terms of height, square footage, and materials.  Also, per the plan sheets, will be located outside of the Vision Clearance Triangle as defined in City Code.

Funding Source:

The cost for recording the Easement Encroachment Agreement against the Subject Property will be the responsibility of the Applicant.

Recommendation:

Staff recommends adopting Resolution #17-02-043 approving the Easement Encroachment Agreement to allow the installation of a project sign within a drainage and utility easement on Lot 49, Block 1 Station.

Action:

Motion to adopt Resolution #17-02-043 approving the  Easement Encroachment Agreement to allow the installation of a project sign within a drainage and utility easement on Lot 49, Block 1 Station.
