Adopt Resolution #17-04-097 Approving Joint Powers Agreement with Anoka County for Conveying Park Property and Constructing Riverdale Drive Extension
Purpose/Background:
Purpose:
The purpose of this case it to adopt Resolution #17-04-097 approving a Joint Powers Agreement between Anoka County and the City of Ramsey as requested by Anoka County so Anoka County Park property can be conveyed to the City for construction of the Riverdale Drive extension between Traprock Street and Ramsey Boulevard as part of City Improvement Project #16-20.
Background:
Anoka County requests City of Ramsey approval of the attached draft Joint Powers Agreement (JPA) that defines the terms of agreement between Anoka County and the City of Ramsey for conveying 5.31 acres of Anoka County’s Mississippi West Regional Park property for construction of the Riverdale Drive Extension between Traprock Street and Ramsey Boulevard. The JPA defines the respective rights and responsibilities of both parties related to the conveyance of property and the construction of Riverdale Drive.
Approval of the draft JPA will allow the City to move forward with the Riverdale Drive Extension project in 2017, including using the $584,280 in Cooperative Agreement funding awarded to the City by the Minnesota Department of Transportation (MnDOT) through the Metro Municipal Agreement Program. Accepting the awarded funds for the Riverdale Drive Extension project obligated the City to letting the project by June 30, 2017. If this does not happen, funding may be withdrawn. Approving the JPA now will allow the City to let the project by June 30, 2017.
The City Attorney reviewed and approved the attached draft JPA.

Alternatives:
Alternative #1 – Motion adopting Resolution #17-04-097 approving the Joint Powers Agreement with Anoka County for conveying Park property and constructing Riverdale Drive Extension.
Alternative #2 – Motion denying adoption of Resolution #17-04-097 at this time.
The most pertinent conditions of the JPA include;
- The City must reimburse Anoka County in the amount of $200,000 for the required 5.31 acres of roadway right-of-way. This is based on an appraisal completed by the City, which Anoka County accepted. Upon payment, Anoka County shall convey the property by Quit Claim Deed to the City.
- The City will pay all costs for designing, bidding, and constructing the Riverdale Drive extension, except for any water services stubbed to the Park property which Anoka County will pay for.
- Anoka County will retain a small easement area for maintaining the billboard in the northeast corner of the Park.
If the City does not approve the draft JPA as requested by Anoka County the City may lose $584,280 of awarded MMA funding.
Alternatives:
Alternative #1 – Motion adopting Resolution #17-04-097 approving the Joint Powers Agreement with Anoka County for conveying Park property and constructing Riverdale Drive Extension.
Alternative #2 – Motion denying adoption of Resolution #17-04-097 at this time.
Funding Source:
As previously noted, the City must reimburse Anoka County in the amount of $200,000 for the required 5.31 acres of roadway right-of-way. These funds are proposed to be paid from MSA funds.
Recommendation:
Staff recommends alternative #1.
Staff does not support Alternative #2 as this could negatively impact the project letting date which could result in the City losing the awarded MMA funds.
