Consider Actions for Riverstone Addition Located Near Bunker Lake Boulevard and Puma Street; Case of Capstone Homes (Project No. 17-106)
  1. Introduce Ordinance #17-06 Approving Zoning Amendment to Planned Unit Development (PUD)
  2. Adopt Resolution #17-06-144 Declaring Environmental Impact Statement Not Needed and Approving Preliminary Plat

Purpose/Background:

Note: This case was updated on June 9, 2017. The following items were added.

The purpose of this case is to review a Preliminary Plat for a 293 lot subdivision (245 detached single-family and 48 townhomes). The Preliminary Plat also requires the approval of a Planned Unit Development (PUD).

Notification:

Staff attempted to notify all Property Owners within 700 feet of the Subject Property of the Preliminary Plat Review.

Observations/Alternatives:

There are a number of layers to the review of this project. Please see the attached review letter for specific review. Topics include, but are not limited to, the following:
  • Comprehensive Plan
  • Zoning and Subdivision Code
  • Collector/Arterial Streets/Cost Share
  • Park Dedication
Detailed review of the proposed subdivision is included in the attached Staff Review Letter. Approval of the Preliminary Plat has several contingencies outlined in the Staff Review Letter and Resolution #17-06-144.

Alternatives

Alternative #1 - Approve the Preliminary Plat as presented. Staff believes that the proposed contingencies are appropriate for approval, acknowledging that additional steps are forthcoming. Preliminary Plat is focused on giving approval to layout, with specific agreements and construction plans approved with Final Plat. Staff recommends this alternative.

Alternative #2 - Postpone action to resolve contingencies and bring back revised Preliminary Plat for consideration. Several of the contingencies are standard and would carry forward regardless of amended plans. However, there are items of clarification and plan revisions requested that could be updated before approving. Staff could support this action if necessary. The City Council should still act on the Environmental Assessment Worksheet in this alternative. Staff will walk the City Council through this step if necessary with appropriate motion. The motion for this alternative would be to motion to adopt Resolution #17-06-144 declaring an Environmental Impact Statement is not required and striking Items #2 and #3 from said resolution.

Alternative #3 - Deny the Preliminary Plat.

Funding Source:

All costs associated with processing the Application are the responsibility of the Developer. Interior infrastructure as part of the project area are the responsibility of the Developer. The Developer is responsible for standard Development Fees.

Staff does note that this project is contingent upon approval of an Assessment Agreement that would include the City contributing to the cost of improvements to Bunker Lake Boulevard and Puma Street. This aspect will be handled as a separate case in the future.

Recommendation:

The Planning Commission recommends approval of this project as outlined in the Staff Review Letter (amended/updated version was posted June 9, 2017).

Action:

Motion to introduce Ordinance #17-06 approving a Zoning Amendment to Planned Unit Development and adopt Resolution #17-06-144 approving the Preliminary Plat for Riverstone Addition.
