Title:

REVISED: Approve Actions for Riverstone Addition Located Near Bunker Lake Boulevard and Puma Street; Case of Capstone Homes (Project No. 17-106)
  1. Adopt Ordinance #17-06 Approving Zoning Amendment to Planned Unit Development (PUD)
  2. Adopt Ordinance #17-07 Vacating Certain Easements
  3. Adopt Resolution #17-07-186 Approving Final Plat and Development Agreement

Purpose/Background:

The purpose of this case is to review a Final Plat for a 51 lot phase of a 293 lot subdivision (245 detached single-family and 48 townhomes). The Plat also requires the approval of a Planned Unit Development (PUD).

Note: Staff is still working on minor requested revisions by the Developer on the Development Agreement. In the interest of attempting to keep the requested project schedule, Staff has forwarded this case at this time. If the City Council is not comfortable taking action with these items resolved, the City Council is able to postpone action. Staff believes the requested revisions are relatively minor and do not change the material findings of the Development Agreement. Staff will provide an update on Monday, July 24 or Tuesday, July 25.

Notification:

Staff attempted to notify all Property Owners within 700 feet of the Subject Property of the Preliminary Plat Review.

Observations/Alternatives:

There are a number of layers to the review of this project. Please see the attached review letter for specific review. Topics include, but are not limited to, the following:
  • Comprehensive Plan
  • Zoning and Subdivision Code
  • Collector/Arterial Streets/Cost Share
  • Park Dedication
Detailed review of the proposed subdivision is included in the attached Staff Review Letter. Approval of the Preliminary Plat has several contingencies outlined in the Staff Review Letter and Resolution #17-06-144.

Street Names

The Developer has requested to deviate from the standard Anoka County Grid naming convention. The Public Works Committee reviewed this policy broadly at their July 18th Meeting. The Public Works Committee recommended that the street names remain in the same naming category (animals), start with the correct letter in the grid, but could deviate from the convention within these parameters. Following the County Grid is important for public safety response.

Alternatives

Alternative #1 - Approve the Final Plat as presented. Staff believes that the proposed contingencies are appropriate. As presented, this action would be contingent on approval of final plans by the City Engineer

Alternative #2 - Postpone action to resolve contingencies and bring back revised Final Plat for consideration. Several of the contingencies are standard and would carry forward regardless of amended plans. In terms of the requested revisions to the Development Agreement, Staff believes these can be worked through administratively. Staff could support this action if necessary.

Alternative #3 - Deny the Final Plat.

Funding Source:

All costs associated with processing the Application are the responsibility of the Developer. Interior infrastructure as part of the project area are the responsibility of the Developer. The Developer is responsible for standard Development Fees.

Staff does note that this project is contingent upon approval of an Assessment Agreement that would include the City contributing to the cost of improvements to Bunker Lake Boulevard and Puma Street. This aspect will be handled as a separate case this evening.

Recommendation:

The Planning Commission recommends approval of this project as outlined in the Staff Review Letter.

Action:

Motion to waive the City Charter requirement to read the ordinance aloud -AND- adopt Ordinance #17-06 approving a Zoning Amendment to Planned Unit Development.

Motion to adopt Resolution #17-06-144 approving the Final Plat and Development Agreement for Riverstone Addition.

?(Action Note: By adopting the resolution as drafted, the City Council is approving the Development Agreement as currently drafted without requested revisions by Capstone, subject to review and approval by the City Attorney as to legal form. This is Staff's recommended alternative to avoid deviations from our standard Development Agreement provisions.)
