Title:

Public Hearing to Consider the Feasibility Study for Infrastructure Improvements Associated with the Legacy Christian Academy Development
 

Background:

Staff has been reviewing a development application for a proposed K-12 school project to be located west of Armstrong Boulevard on a roadway extension of Bunker Lake Boulevard.  On September 23, 2010 a petition was received requesting utility and roadway improvements to serve this project.  The petition was accepted by the City Council on October 12, 2010, and Bolton & Menk was awarded a contract to undertake the preparation of the feasibility study.
 
On November 9, 2010 the Council accepted the feasibility study and called for the public hearing.  Over the past few weeks staff has continued negotiations with the applicant on the improvements that would be required to serve the project site, and the means of funding those improvements.  The feasibility report has been updated (IS IN THE PROCESS OF UPDATE & WILL BE AVAILABLE...) to include the following revisions:
        The westerly extension of Bunker Lake Boulevard has been reduced approximately 1250' to the westerly access
     point to the phase 1 school project.  This extension includes 2 lanes of roadway, trail along the north side,
     all utilities, and concrete curb & gutter.
        The remaining extent of Bunker Lake Boulevard, from the westerly access point into the school project to
     Puma Street, will be improved to minimum paving standards; with 2 lanes of traffic and no utilities or curb
     & gutter.
        The improvement of Puma Street to miminum paving standards; with 2 lanes of traffic, no utilities, and
     a trail along the west side.
        Clarification of the funding breakdown to include the assessment of all project fees and infrastructure costs
     over a 20 year period.  This also includes the deferrment of assessments on Outlots B and D, in the amount
     of approximately $800,000, for a period of 3 years.
 
The total estimated cost of improvements outlined in the feasibility study are $1.95M, of which the applicant will be responsible for approximately $1.4M.  An additional $411,000 will be assessed to the applicant for their development fees above and beyond the cost of the infrastructure improvements.  The City's costs for this project are proposed to be approximately $600,000 and include a sanitary sewer extension along Armstrong Boulevard from Sunwood Drive to the fire station, a trail along the west side of Armstrong Boulevard from Bunker Lake Boulevard to Alpine Drive, and full construction of the westerly leg of the Armstrong and Bunker Lake Boulevard intersection improvements (required under the Regional Roadway Improvements for the COR) for a distance of 300'.
 
It is anticipated that construction of the improvements contained within this feasibility study will be combined with the Armstrong and Bunker Lake Boulevard intersection improvement project (signalization) and constructed in the spring/summer of 2011.  Council authorized the distribution of an RFP to prepare construction documents for this project on October 26, 2010; this item will come back to Council for action once the feasibility study is approved and the final scope of improvements is identified for the Legacy Christian Academy project.

Notification:

Proper notice was published in the Anoka County Union, consistent with State statutes, calling December 14, 2010 as the public hearing date on this matter.

Observations:

Since the developer is the only benefitting petitioner and wants to take advantage of the competitive bidding environment, they are waiving their 60 day waiting period for the ability to counter petition the improvements in the language of the Development Agreement.

Recommendation:

Staff recommends holding the public hearing, approve the feasibility study for the infrastructure improvements associated with the Legacy Christian Academy project, and order the project by authorizing Staff to issue an RFP for design services.
 

Funding Source:

Funding for most of these improvements is being assessed to the applicant as outlined above, with a portion being paid by the City.  Funding and sources will be outlined in the Feasibility Study. The cost for design services to incorporate the infrastructure that was petitioned is expected not to exceed $106,000. The developer has agreed to pay these costs if these infrastructure improvements are realized to be too expensive as identified in the bidding process.

Council Action:

Hold the Public Hearing, approve the feasibility study for the infrastructure improvements associated with the Legacy Christian Academy project, and order the project by authorizing Staff to issue an RFP for design services contingent upon the Developer agreeing to pay the cost for these additional design services at a cost not to exceed $106,000.
