Approve Greenway Terrace Right of Entry Agreement

Purpose/Background:

PURPOSE
Approve the attached right-of-entry agreement.

During construction of the proposed apartment complex, located on Lot 1 Block 1 Greenway Terrace, Aeon's general contractor will need access to the adjoining city-owned property for temporary construction staging and access (Outlot A, Greenway Terrace).  This temporary agreement will allow for orderly and efficient construction of the proposed project.  This is a common request for construction projects.  Staff considers this an administrative request--and has reviewed this agreement with the City Attorney.


BACKGROUND
On November 29, 2017, the city closed on the sale of a roughly 88,000 sf parcel of city-owned land to Aeon. The City began working on this project in March of 2016 (site selection) and entered into a purchase agreement in May of 2016. This project is located in The COR, just north of The Draw, and includes a 54-unit workforce apartment complex. The City sold its property for $183,000. This project is anticipated for completion by the end of 2018.

Staff would note, Aeon has a separate second PA in place with the City, for a 59,000 sf property located directly adjacent to, and contiguous with, the 54-unit apartment project mentioned above. Aeon is hopeful to begin working on this second site soon. Closing on the second site is planned for fall of 2018.  The proposed right-of-entry agreement would be located on the "phase II" parcel.
