Title
Adopt Resolution #18-135 Releasing the Property at 8390 Riverdale Drive NW from the Alpaca Estates 4th Addition Development Agreement; Case of Shorewood RV
Purpose/Background:
Shorewood RV, operating at 8390 Riverdale Drive NW, is in the process of selling to Lazy Days RV. As part of the due diligence prior to closing, Staff has received a request for either a Certificate of Completion relating to or a Release from Development Agreement for the Alpaca Estates 4th Addition Development Agreement, which is recorded against the four (4) parcels being acquired (PID #s 29-32-25-13-0004, 29-32-25-13-0005, 29-32-25-13-0006, and 29-32-25-13-0007, together the "Subject Properties"). The Plat and Site Plan were approved in 1997 and it appears that all required improvements in the Development Agreement have been satisfied. The request is intended to simply get confirmation that there are no other obligations from that Development Agreement that would be applicable to the Subject Properties. The Development Agreement essential outlined the required improvements for the initial development of the plat (streets, stormwater ponds, etc.) and payment of development fees.
Note that one of the four pacrels is an outlot and thus, any future improvements there would first require a platting into a lot and block. That platting process would trigger a new Development Agreement to summarize exactly what improvements were to be installed and whose responsibility those would be.

This request is being handled as part of Staff's normal duties.
Recommendation:
Staff recommends granting the Release from Development Agreement for Alpaca Estates 4th Addition for Lots 1-3 Block 1 (inclusive) and Outlot A.
Action:
Motion to adopt Resolution #18-135 releasing the Development Agreement for Alpaca Estates 4th Addition on the Subject Properties.
