Adopt Resolution #18-164 Authorizing Final Payment to North Valley, Inc for Improvement Project 16-98, Central Park Parking Lot.

Issuing final payment will be contingent on receipt of the following items from North Valley, Inc.:

1. IC 134 (Contractor’s Withholding Affidavit showing compliance with the provisions of Minnesota Statute 290.92 requiring withholding state income tax)
2. Waiver of Mechanic’s Lien Rights (Affidavits that all claims against North Valley, Inc. by reasons of the contract have been fully paid or satisfactorily secured)
3. Consent of Surety to Final Payment (Certification from the contractor’s surety)

Following receipt of these items, final payment will be issued.

The Senior Engineering Technician has inspected the completed work and recommends final payment to North Valley, Inc. for Improvement Project 16-98, Central Park Parking Lot in the amount of $47,423.05.

Final payment for this project exceeds the contract amount by $26,786.02.  This is primarily due to two pay item quantities over-running the contract quantities, those being common topsoil borrow and erosion control blanket.  During construction, adjustments needed to be made to site grading in a couple of areas to better facilitate drainage and to flatten out the area between the north curb line and the ball fields so fans can better observe games from a much more level area.
